With the return of Colorado Governor Frederick Pitkin to Denver, the question was argued by attorneys for both sides. The state’s case argued that John Henry Holliday “should be delivered to the Arizona authorities as they were demanding him on a clearly-worded indictment, for a capital crime, and with a direct requisition from the Governor of the Territory.” Holliday’s lawyers (led by attorney John T.
